Who we are and what these Terms cover

These Terms of Service ("Terms") are an agreement between you and WinBell ("WinBell", "we", "us"), a company based in Quebec, Canada, which makes TekeMab. They cover the TekeMab app on Android and iOS, its online services (accounts, cloud saves, rewards) and the website tekemab.com (together, the "Service").

By tapping Accept and continue in the game, or by using the Service, you agree to these Terms and to our Privacy policy. If you don't agree, please don't use the Service.

Age and parents

TekeMab is made for players of every age.

• If you are under 18, or under the age of majority where you live, a parent or legal guardian must read these Terms, accept them for you, and is responsible for how you use the Service.
• Players under 13 get extra protections: ads are non-personalized and rated G, optional analytics stay off, and their account cannot be saved with Google or Apple. The Privacy policy explains this in detail.

Your account

• Automatic account: after you accept these Terms and the Privacy policy, the game creates a guest account for your progress. A guest account lives on your device: if the game is removed or the device is lost, it cannot be recovered.
• Saving with Google or Apple: players 13 and over can link their account to Google or Apple to keep it and play it on another device.
• One person per account: you may not sell, buy, trade, give away or share accounts, or use someone else's.
• Keep it safe: you are responsible for activity on your account and on the Google or Apple account you link to it.
• Leaving: you can delete your profile and online account at any time in the game (Profile → Delete profile).

Gold, marbles and other game items

Gold, marbles, shooter finishes, energy, chests, Pickers and every other item or currency in TekeMab ("game items") are part of the game, not property.

• You earn game items by playing and, when you choose, by watching rewarded ads. TekeMab has no real-money purchases today.
• Game items have no money value. They cannot be exchanged for money or anything outside the game, and cannot be sold, bought, traded or transferred, inside or outside the game.
• We give you a limited, personal licence to use game items while you play. We may change, rebalance or retire items, prices and rewards to keep the game fair and working.
• If a bug, an outage or a mistake gives you items or progress you shouldn't have, or removes some, we may correct it.
• If real-money purchases are ever added, these Terms will be updated before they are offered, and the store's rules on payments and refunds will apply.

Ads and rewards

• Ads keep TekeMab free. Rewarded ads are always optional: the reward is given after the ad network confirms the ad was watched, up to a daily limit.
• Rewards may be withheld or removed when ad activity is invalid: automated or scripted views, emulators, tampering, clicking ads you don't mean to visit, or anything else meant to inflate ad views or clicks.

Playing fair

To keep TekeMab fair and safe, you agree not to:

• cheat, or use bots, scripts, macros, modified or unofficial versions of the app, or tools that read or change its data, to gain an advantage;
• exploit bugs or errors (please report them to support@tekemab.com instead);
• send automated, forged or excessive requests to our servers, or interfere with the Service, other players or our security;
• copy, decompile, reverse-engineer or modify the app, except where the law allows it despite this rule;
• create or use several accounts to collect rewards you couldn't get with one;
• generate invalid ad activity, as described above;
• use a name or anything else in the Service that is offensive, impersonates someone, or shares personal information;
• use the Service for anything unlawful, or in breach of the rules of Google Play or the App Store.

What happens if the rules are broken

We choose the smallest response that stops the problem, depending on how serious and repeated it is:

• a warning;
• removing items, rewards or progress gained by breaking the rules;
• restricting a feature, for example pausing rewarded ads or resetting a name;
• suspending the account for a period;
• closing the account permanently. A permanent ban is always decided by a person, never only by an automatic rule.

When a restriction applies, the game tells you what is restricted, why (the kind of rule broken) and until when. If something is very serious or unlawful, we may act at once.

Appeals: if you think we made a mistake, email support@tekemab.com with your player name (shown on your profile). A person will review it and reply. For players under 13, a parent or guardian should write to us.

You can still delete your data while a restriction applies.

Updates and availability

• We improve TekeMab over time: features, rules, items and balance may change, and some may be removed.
• Some updates are required to keep playing online. Offline play continues on your device where possible.
• We work to keep the Service available but cannot promise it will always be uninterrupted or error-free.
• We may stop the online Service. If we do, we will announce it in the game or on tekemab.com at least 30 days before, except where we must act sooner for legal or security reasons.

Our content and your licence

TekeMab, its code, art, sounds, names and logos belong to WinBell or its licensors. We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the app on devices you own or control, for your own non-commercial use. Everything not expressly given to you is reserved.

The Service uses services from other companies, including Google (AdMob, Firebase, Google Play, Google sign-in), Apple (App Store, Sign in with Apple) and Supabase. Their own terms also apply to what they provide.

If you send us ideas or feedback, we may use them without owing you anything.

Your privacy

How we handle your information is explained in our Privacy policy, which is part of these Terms.

Our responsibility

We provide TekeMab with care, but as a free game it comes "as is" and "as available", to the extent the law allows. To the extent the law allows, WinBell is not liable for indirect or consequential losses, or for the loss of game items, which have no money value.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived, including the Quebec Consumer Protection Act, or our liability where the law does not allow it to be limited.

Ending these Terms

You can stop using the Service and delete your profile at any time. We may suspend or end your access as described in "What happens if the rules are broken". Sections that by their nature should continue (such as game items having no money value, our content, responsibility and the law that applies) continue after the Terms end.

Changes to these Terms

When we change these Terms, we update the version and date at the top. If a change matters to you, the game asks you to accept the new version before you continue playing online. The current version is always at tekemab.com/terms/.

Law and disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Disputes go before the courts of Quebec. If the law where you live gives you the right to bring a dispute before your local courts, or to rely on its consumer protections, these Terms do not take that away. Please contact us first: most problems can be solved by email.

Google Play and the App Store

• These Terms are between you and WinBell, not Google or Apple. Google and Apple are not responsible for the Service, its content, its support or any claim about it.
• On iOS, Apple's Licensed Application End User License Agreement also applies. Apple has no obligation to provide maintenance or support for TekeMab. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as an iOS user.
• The store you downloaded TekeMab from has its own rules, which also apply.

Languages

These Terms are available in English, French, Haitian Creole, Spanish, German, Dutch, Portuguese and Italian. For residents of Quebec, the French version is the reference version. Elsewhere, if the versions differ, the English version applies, without reducing any right your local law gives you.
